RCS and SMS Messaging Terms & Conditions

Bond Oxborough Phillips ("we", "us" and "our") may contact you using Rich Communication Services (RCS) and, where RCS is unavailable or unsupported, by SMS. These terms explain the types of messages we send, why we send them, how your information is used and how you can stop or manage messages.

This messaging service is currently being introduced through our Bideford sales office. These terms apply alongside our Privacy Policy and Complaints Procedure.

1. Who we are

Bond Oxborough Phillips is an independent estate agency operating in the United Kingdom. The contact address for this messaging service is 5 Bridgeland Street, Bideford, Devon, EX39 2PS.

2. Messages we may send

We may send:

  • Service messages, including valuation and viewing arrangements, appointment confirmations and reminders, offers, viewing feedback, updates about the marketing of a property you have instructed us to sell, sales-progression updates, and other administrative information connected with a service or property transaction.
  • Marketing messages, including property alerts, market updates, guides, news and information about our services, but only where we are legally permitted to send them.

Service messages will be administrative and will not contain promotional content. If promotional content is included, we will treat the entire message as marketing.

Message frequency will vary according to your dealings with us. If you have an appointment, active property search or transaction, you may receive messages more frequently while that activity continues.

3. Why we send messages

We send service messages where this is necessary to provide a service you have requested, to take steps in connection with a possible contract, to perform a contract, to comply with a legal obligation, or for our legitimate interests in operating and progressing our estate-agency services.

Service messages are not direct marketing. Where we send marketing messages to an individual, we will do so only with consent or where the law permits us to use the existing-customer exception (sometimes called the "soft opt-in"). Where that exception applies, it is used only for our own similar services and only where an opportunity to opt out was provided when the contact details were collected and in each subsequent marketing message.

4. Stopping or managing messages

You may object to or withdraw your consent to marketing at any time. You can:

  • reply STOP to an RCS or SMS message; or
  • contact us using the details in section 1 and tell us which communications you want to stop.

We will action marketing opt-outs as soon as reasonably practicable. We may retain the minimum information needed on a suppression list so that we continue to respect your preference.

Replying STOP will stop future RCS and SMS messages sent through this messaging service to that mobile number. If we still need to communicate with you about an appointment, active transaction or legal obligation, we may contact you by another appropriate method, such as telephone, email or post.

We do not charge you for opting out. Your mobile network's normal message or data charges may apply.

5. Personal data and messaging providers

To provide this messaging service, we may process your name, mobile telephone number, property or transaction reference, message content, communication preferences, and technical information such as delivery status and interactions with a message.

Our messaging service uses SMS Speedway, Google RCS Business Messaging and participating mobile networks. To deliver, secure and monitor messages, relevant information may be disclosed to and processed by these providers. Depending on the activity involved, a provider may process information on our behalf or for its own network, security, fraud-prevention or spam-prevention purposes.

We use messaging information to deliver and manage messages, maintain an appropriate record of communications, deal with enquiries, operate opt-outs, and protect the security and integrity of the service.

This section supplements our Privacy Policy, which explains how long we retain personal data, the rights available to you under UK data protection law, and how to contact us about those rights.

6. Costs, compatibility and availability

We do not charge you for receiving our messages. RCS uses mobile data and your network provider's normal data or messaging charges may apply. If RCS is not available on your handset or network, a message may be delivered as an ordinary SMS and may appear in a simpler format.

Message delivery depends on third-party networks, platforms and handset compatibility. We cannot guarantee that a message will always be delivered, displayed correctly or received by a particular time.

7. Accuracy and security

We take reasonable care when preparing messages. If a message appears incomplete, contains an error or conflicts with formal transaction documents, please contact us before relying on it.

Take particular care with any unexpected request involving money or bank details. Verify such a request using a telephone number obtained independently from our website before taking action.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, or affects your statutory rights.

8. Complaints and questions

If you have a question or complaint about a message, please contact us using the details in section 1. Our full complaints process is available in our Complaints Procedure. Depending on the nature of a complaint and once our internal procedure has been completed, you may be able to refer it to The Property Ombudsman.

If your concern relates to the use of your personal data, you also have the right to complain to the Information Commissioner's Office.

9. Changes to these terms

We may update these terms from time to time. The current version will be published on this page. Where appropriate, we will draw significant changes to your attention.
